Jacaranda, The Ummed in Ahmedabad, a prestigious establishment known for its luxurious setting and exquisite cuisine, has recently been found to engage in deceptive billing practices by including a 4.24% service charge in their bills. They have unfortunately chosen to position it just before CGST and SGST amounts. This placement can easily mislead diners into believing that the service charge is a legal tax, rather than an optional fee. The lack of transparency surrounding this charge is concerning, especially since it is not accompanied by any footnote or fine print indicating that it is not mandatory. This practice stands in stark contrast to the notification issued on December 14, 2016, by the Ministry of Consumer Affairs, Food and Public Distribution, Government of India, which clearly states that service charges are not mandatory. Consumers have the right to refuse to pay these charges if they choose to. By not clearly disclosing this information, The Ummed is engaging in an ethical malpractice that undermines consumer rights and trust. This, coupled with the subsequent calculation of CGST and SGST on the total bill amount, results in patrons paying more than they should.
